Nina’s Pedestrian Accident Claim

Nina Tang from Manchester asked us to deal with her pedestrian accident claim.

She was crossing the road with her sister at a zebra crossing on her way to Morrison’s.

But as she crossed a car came along the road from her right, failed to stop and knocked her down.

Car drivers have a legal duty to take care for the safety of other road users, including pedestrians.

The Highway Code (Rule 195) says that drivers must give way when a pedestrian has moved onto a crossing.

So colliding with a pedestrian on a zebra crossing is clear evidence of  negligence.

And if a pedestrian is injured as a result of a driver’s negligent driving they are entitled to claim compensation.

We contacted the insurers for the negligent driver and they admitted liability for the accident.

Nina suffered an injury to her left shoulder but luckily it turned out to be not too serious.

A medical expert prepared a report about her injury.

The expert said Nina would fully recover once she had some physiotherapy.

The insurers agreed to negotiate with us once we disclosed the medical evidence.

And Nina accepted an offer of £8000 in settlement of her claim.
